Terms of Service

1. Acceptance of Terms

By accessing or using GetFlatPal (“the Platform”, “we”, “us”), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you must not use the Platform.

These Terms constitute a legally binding agreement between you and GetFlatPal, governed by the laws of the Czech Republic, in particular Act No. 89/2012 Coll. (Civil Code) and Act No. 480/2004 Coll. on Information Society Services.

2. The Platform

GetFlatPal is an online classifieds platform that allows users to post and browse room listings and flatmate profiles in the Czech Republic. We are a technology intermediary — we do not own, manage, or let any properties listed on the Platform, and we are not a party to any tenancy agreement entered into between users.

We provide the Platform free of charge. We reserve the right to introduce paid features in the future; any such change will be communicated with at least 30 days' notice.

3. Eligibility

To use GetFlatPal you must:

• Be at least 18 years of age.
• Be legally capable of entering into binding contracts under Czech law.
• Not be prohibited from using the Platform under any applicable law.
• Provide accurate, current, and complete information during registration.

4. Listings

When posting a listing, you agree that:

• All information — including price, location, photos, and property description — is accurate and not misleading.
• You are the owner, authorised subletter, or agent with written permission to advertise the property.
• The listing does not violate any applicable tenancy laws, including Act No. 67/2013 Coll. on services connected with use of flats.
• You will update or remove the listing promptly once a room is no longer available.
• Photos are your own or used with appropriate rights. You grant GetFlatPal a non-exclusive licence to display them on the Platform.
• Listings must not discriminate unlawfully on the basis of race, nationality, gender, sexual orientation, disability, religion, or other protected characteristics under Czech anti-discrimination law (Act No. 198/2009 Coll.).

We reserve the right to remove any listing that breaches these Terms or that we deem inappropriate, without notice and without liability.

5. Messaging

The Platform provides a messaging system to allow users to communicate about listings. You agree to use this system only for its intended purpose — discussing rooms, viewings, and tenancy arrangements.

You must not use the messaging system to:

• Send spam, unsolicited commercial messages, or phishing attempts.
• Harass, threaten, or abuse other users.
• Share personal contact details before establishing a genuine mutual interest in a listing.
• Solicit payments outside the Platform for services we do not offer.
• Transmit malware, viruses, or any harmful code.

We may review messages where we have reason to believe a violation has occurred. We will handle any such data in accordance with our Privacy Policy.

6. User Conduct

You agree not to:

• Create false or duplicate accounts, or impersonate another person or entity.
• Scrape, crawl, or harvest data from the Platform by automated means without our written consent.
• Attempt to gain unauthorised access to any part of the Platform or its underlying systems.
• Post content that is defamatory, obscene, fraudulent, or otherwise unlawful under Czech law.
• Interfere with the integrity or performance of the Platform or its infrastructure.
• Use the Platform for any commercial purpose not expressly permitted, including running an unlicensed estate agency.

7. Accounts

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at hello@getflatpal.com if you suspect unauthorised use of your account.

We may suspend or permanently terminate your account if you breach these Terms, with or without notice depending on the severity of the breach.

8. Disclaimer of Warranties

The Platform is provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that:

• Listings are accurate, complete, or up to date.
• The Platform will be uninterrupted, error-free, or free of viruses.
• Any agreement reached between users will be honoured.

You use the Platform and any information obtained through it at your own risk. Always verify listing details in person before entering into any tenancy agreement.

9. Limitation of Liability

To the fullest extent permitted by Czech law, GetFlatPal shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use the Platform, including loss of data, loss of profit, or disputes between users.

Our total liability to you for any claim arising out of or relating to these Terms or the Platform shall not exceed CZK 1,000.

10. Intellectual Property

All content on the Platform that is not user-generated — including the GetFlatPal name, logo, design, and underlying code — is owned by or licensed to us and may not be reproduced, distributed, or used without our written permission.

You retain ownership of content you post. By posting, you grant us a worldwide, royalty-free, non-exclusive licence to host, display, and distribute that content solely for the purpose of operating the Platform.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or by a notice on the Platform at least 14 days before they take effect. Continued use of the Platform after the effective date constitutes acceptance of the revised Terms.

12. Governing Law and Disputes

These Terms are governed by the laws of the Czech Republic. Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of the Czech Republic.

If you are a consumer, you also have the right to use alternative dispute resolution through the Czech Trade Inspection Authority (ČOI) at www.coi.cz.
